Nobisco Terms and Conditions General These terms and conditions will apply
to the sale of goods by Nobisco Ltd and will take precedence over any
other terms and conditions which might originate from the customer.
Variations on these Terms and Conditions will only be valid if confirmed
in writing and signed by a Director of Nobisco Ltd. This contract will
be governed by and interpreted in accordance with English law. Price Prices quoted by Nobisco may be changed
at any time and without notice. Goods will be invoiced at the prices
ruling at the time an order is placed. Prices quoted are exclusive
of VAT or delivery costs. Payment Cleared payment must be received for the full value of the goods including VAT and delivery costs prior to the order being accepted and goods despatched. Customers holding credit accounts are required to pay in full for goods by the end of the month following the month of delivery unless otherwise contracted in writing and signed by a director of Nobisco Limited. Interest will be charged daily at 8% by Nobisco on balances outstanding beyond the due payment date. An administrative charge of £20 will be applied to a customer's account for each cheque returned by the bank. The customer cannot offset any claim
against full payment for the goods. Title of the goods remains with
Nobisco Ltd until payment has been received in full. Delivery Goods held in stock are generally delivered to customers on the UK mainland within 48 hours of the order being placed. Shipping of bulky deliveries and deliveries being sent directly from manufacturers can take longer. Occasionally goods will be out of stock in which case the customer will be advised and a revised lead time quoted and / or alternative goods offered. Where goods are manufactured specifically for a customer approximate delivery times will be given however Nobisco cannot be held liable for any delays in the manufacturing process or subsequent delivery. Nobisco will not be liable for any claim arising from the failure to deliver goods within a certain time, or for damage to the goods whilst in transit. Once goods have been delivered and signed
for by the customer they are held at the customers own risk. Nobisco
must be advised in writing (sales@nobisco.co.uk) of any shortages or
damaged goods within 48 hours of the delivery. Carriage Carriage costs will vary however guidelines
are available at our website - www.nobisco.co.uk. Returns The return of goods is entirely at the
discretion of Nobisco Ltd. For returns to be considered, goods must
be in their original condition. Goods must be returned to Nobisco Ltd
within 14 days of delivery at the customer's expense. Goods must be
accompanied by a Returns Reference Number which can be obtained by phoning
0800 197 5656. Nobisco reserves the right to charge the customer a handling
fee of 20% or the cost of the goods. Goods which have been manufactured to customer's requirements (e.g. printed products) cannot be returned unless they are faulty. Nobisco should be advised within 5 days of the delivery date of any such defect. The above does not affect your statutory
rights as a consumer. Full details of "The Consumer Protection
(Distance Selling) Regulations 2000" can be found at http://www.hmso.gov.uk/si/ Website and Promotional Material Great care is taken to ensure that images and specifications appearing on the Nobisco website or in promotional material are correct. Nobisco does not accept any liability for errors or omissions and we reserve the right to make alterations without notice. Customers using our website will be issued
with a password. It is the customer's responsibility to change this
password within 24 hours of receipt; this can be done by logging into
the website and accessing the user settings facility. It is the customer's
responsibility to ensure that only authorised staff have access to the
password. Nobisco are not liable for any loss resulting from the misuse
of the password. Privacy Nobisco does not pass customer data to
third parties. Information is only used for marketing purposes with
the customers consent. Nobisco is registered and complies with the Data
Protection Act. Warranty Goods supplied by Nobisco Ltd are guaranteed in accordance with the manufacturer's warranty. Warranties do not cover wear and tear or instances where a product has been abused. If you wish to raise a complaint please

0800 1975656. We will respond to all complaints within five working days. Force Majeure Nobisco will not be liable for the consequences
of any delays or failures resulting from circumstances beyond its reasonable
control. Such circumstances might include but not be limited to acts
of God, strikes, accidents, hostilities, plant breakdown or shortages
of raw materials. Nobisco may under the terms of Force Majeure cancel
a contract without incurring any liability. |
